The Tiverton Town Council & the Truth

The Tiverton Town Council has been open and honest with all Taxpayers over the last two years despite numerous false statements and lies repeated at meetings and reported in the media.

The Tiverton Town Council has done well in the last two years, so well in fact that the detractors of the present Town Council have had to resort to false statements and lies in order to disparage them.  The present Town Council has some enemies because it works hard to keep the taxes below the State Tax Cap during this time of recession/depression, so that those on fixed income (or no income) do not loose their homes in Tiverton (something that some have recommended).  Even criticisms that are true, such as the criticism that the Town Council holds meetings late into the night - sometimes past midnight with the Closed Executive Sessions, - - demonstrate the devotion to duty with the councilors working hard, late into the night, to avoid making decisions without ample study and scrutiny, and keeping the Closed Executive Sessions at the end of the meetings in order to minimize inconvenience to meeting attendees, and in order to fully comply with Open Meeting Law, RIGL 42-46-5(a). 

The Tiverton Town Council has been open and honest with all Tiverton Taxpayers over the last two years despite numerous false statements made by many who oppose the actions made by the Town Council, because the Town Council has clearly indicated that it is in favor of enforcing both the letter of the State Law and the intent of the state law regarding the Tax Cap on the increase to the amount of money that a municipality can demand in taxes from the taxpayers.  The State of RI Tax Cap is now set at 4%, and despite the efforts of the Town Council, the Tiverton School Department has managed to exceed the Tax Cap during the last two years by absorbing the sacrifices made by the Municipal side of the town government up to the maximum combined percentage allowed by the State Tax Cap; and has even exceeded the State Tax Cap last year by obtaining an additional $367,165, via a plan of misinformation and collusion with the RI Department of Education and the refusal of the Superior Court to hear the truth in a Court Hearing. 

Because the School Department has been held to the combined Tax Cap, the School Department has waged a war of false statements against the Town Council over the last two Years.  All of the false statements are clearly contradicted by the facts, and have been repeated by the School Superintendent and several members of the School Committee, as well as others who have little respect for the truth. 

1.   TRUTH The Town Council did not steal $367,165 in 2010, and an additional $243,092 in 2011, from the Tiverton School Department.  The Independent Auditor of the Tiverton Accounts found that the Town Treasurer had made a $367,165 error in 2010 by listing the total amount of anticipated RI State Funding for the Tiverton Schools in the Tiverton School Department Accounts prior to the actual receipt of the funds, and then failed to correct the amount when the actual RI State funds received were $367,165 short of the anticipated amount.  The Tiverton Town Council merely approved the Independent Auditors $367,165 correction. 

 2.   TRUTH The Town Council is not responsible for the expenditure of an additional $80,000 in Tiverton Taxpayer money for legal fees.  The Tiverton School Department is responsible for the expenditure of an additional $80,000 in Tiverton Taxpayer money for legal fees, because the School Department initiated legal action to obtain the $367,165 in 2010, and $243,092 in 2011, from the Tiverton Taxpayers without the required Special Financial Town Meeting  (or FTR) Request to request additional funding in order to replace the RI State Education Funding that the State withheld from the Tiverton Schools. 

      Tiverton Schools received from Tiverton Taxpayers: a 4.576% increase in 2011 (Tax Cap 4.25%), and a 6.0% increase in 2012 (Tax cap 4%) after receipt of disputed $610,257 (3.17% before). 

3.   TRUTH The Town Council is not responsible for spending tens of thousands of dollars on the unnecessary resurfacing of Lawton Avenue and other streets for the personal benefit of Town Council members and their friends. 

      The resurfacing of Lawton Avenue and several other Stone Bridge area streets was a decision made by the Director of Public Works (Not the Town Council) because: 1. the streets were in horrible condition and were breaking up when plowed in the winter; 2. the streets were dug up by the Gas Company in order to replace old gas lines that were unsafe; 3. the Gas Company was willing to pay a significant portion of the repaving work because the replacement of the gas lines was partially responsible for the condition of the roads; and 4. the Gas Company significant contribution to the repaving effort could have been lost if the streets were not quickly repaved before the Gas Company contribution was withdrawn. 

4.   TRUTH The Town Council is not responsible for wasting $58,500 on a Sewer Study to benefit friends of the Tiverton Town Council and TCC.  The truth is that a sewer study has never been performed in Tiverton, the decision to have no sewers was made unilaterally and independently by Louise Durfee, some areas north of Bulgarmarsh Road have no possibility of a septic system other than a storage tank, and the sewer study is required by the State.

5.   TRUTH It is not true that Items deleted by the Budget Committee in 2012, represented voter decisions.  The Budget submitted by the Budget Committee in 2012 was an illegal budget, because it exceeded Town Charter defined Budget Committee Authority.  It was a budget package approved by the intimidation of School Closure, and did not represent any specific voter approval of Budget Committee illegal deletions. 

 Voters who value truth and honesty have an obligation to vote for incumbent Town Council members (and Nancy Driggs who worked diligently for the FTR) who carefully balance the needs of all residents, rather than voting for those endorsed by the purveyors of the false statements and lies, who have a hidden agenda. 

 

NOTE: False statements are the result of errors/incompetence, and/or mental aberration, and/or lies.

1. Auditors do not make corrections. They audit the financial statements of an organization as presented by the Treasurer or Chief Financial Officer of a company. The Town Council didn’t just vote to accept the audit report, they voted to support former Treasurer DiMattia’s action to remove over $600,000 from the school department budget. You can’t blame this on the auditors. 2. The Town Council spent $80,000 dollars of taxpayer money defending themselves and the former treasurer after taking the $600,000 dollars from the schools. At the end of the day the Town Council only returned the money because a judge was going to throw them in jail for ignoring a previous court order to return the money. If the schools were wrong then why did a superior court judge issue a court order to make the Town Council return the money? 3. When did the public works director become an independent entity in Town? He reports to the Town Administrator and the Town Administrator reports to the Town Council. The fact that Lawton Ave was paved and Councilor Coulter lives on this street may be just a weird coincidence, but it is a coincidence none the less. I would also like to point out that Roger Bennis benefited from the paving as he lives on Lawton Avenue as well. 4. The expense for the sewer study was not in the proposed budget at the FTR. Period.

Here are a few facts that good old Bennis left out: What about the pump out boat. In these tough times I am not sure of how many average Tiverton households have the money to afford their own boat, yet we are paying for a boat to float around the Sakonnet to pump out peoples crap. Is this really a pressing need? I am also not sure how Jay Lambert telling people to shut up at Town Council meetings translates into devotion to duty. Telling people to shut up is just plain wrong. Thousands in wasted tax dollars to be told by a court that they were wrong. Doesn’t sound like good stewards of taxpayer dollars.

Can't agree with all your letter. I will say this council has worked it's behind off to make sure the town is in better shape in future years. I'm still firmly against sewers. ISDS . systems meet the towns needs. That is a proven fact and DEM excepted our Waste water commission proposal. We have to agree to disagree.

Another great letter form Colonel Sanders. Can't wait for the rest of the TCC cronies to chime and defend. On another note, i really miss listening to Colonel Sanders rants at the FTM. As you can read above, he still has that ability to make sense -less.

Dear Roger, Let me begin by reminding residents that you a card carrying member of the TCC. Many residents probably don't know that the road you live was paved right after Lawton Ave was paved. Regarding the tax cap, the School Department has not exceeded state mandated limit at anytime over the past two years. Your assertion that they did is a lie. The numbers you supplied are pure fiction. School Department spending has averaged around 2% over the past four years. Everyone in town knows the TCC/Town Council illegally took $600,000 from the School Department. Everyone also knows that the TCC/Town Council refused to acknowledge the legal authority of the Commissioner of Education,and the RI Board of Regents, who ordered the funds to be returned to the School Department. The TCC/Town Council also refused to acknowledge the RI State Supreme Court decision not to entertain their appeal. It was only after the School Committee was forced to subpoena members of the Council to appear before a Superior Court judge did the funds get returned to the School Department. Had the Budget Committee submitted an illegal budget then it would have been rejected by the Office of Municipal Affairs. The TCC diehards would have also challenged the budget if they thought it was "illegal". Once again another TCC lie. Members of the TCC are many things. Being truthful and honest is something they are not.

I love it when an anonymous poster lies while calling another a liar. The Streets that were paved were paid for after the budget committee heard testimony from the public works director . We heard the gas lines were changed on those streets, and national grid would pay for half the paving . The town approved the money based on the budget committees recommendation. That's why those streets were paved. The truth is you have no issues to be proud of so you have to try to convince voters the TCC gets special treatment. If you didn't give away the farm when you were in office we could afford to pave more streets. At least we took advantage of this deal, Those streets were over thirty years old and pot holed . Try telling the truth for a change.

Well, i see the democrat/union/t-1/curb noise machine is gearing up and beginning to hit on all cylinders....I expect this to be a long, long comment trail, with the usual 2or 3 anonymous posters--the ones with multiple identities to make it seem like there are more people in town who actually support the union/t-1/demo claptrap than the few who actually do. Let's review the lies we're going to see: he's stupid; he's in the pocket of his satanic majesty, Lord Nelson; he somehow had a street paved somewhere in town for some purpose--(no one can quite say why or where, or won't put their name to it 'cause they'll get sued for libel);he hates students; he hates teachers; he hates_______ (fill in the blank); he's a tea party member; he's a carpetbagger and new to town. Please add your own.... I announce a contest: who can provide the most amusing lie regarding this letter? Free meat loaf dinner to winner!! Tough to engage either Roger or the TCC candidates on the facts: you'll lose. Ten days to the election: except for 189 teachers, their spouses (we're up to about 400), fellow travellers (425), and everyone who's left (431-ish), the TCC crowd is going to win in a landslide. Me? Fortunately the election is only 9 days away, and once Joe and his fellow TCC cronies go down to defeat, he can go back to cooking hot dogs at the VFW on Shove St.

billy, like you predecessor Fred Floon you have gone 100% negative as the current council has nothing positive to defend. You may think you write a little better than Jim L, but the bottom line is you think and act just like him. You seem to have a pretty good handle on what we don't like about you and Nelly. I hope you've enjoyed the majestic smoothness of Lawton Ave. over the summer, you'll be using it much less in a few weeks. Why no attack letters from anonymous writers signed by Jim L this time around? Is it because you and the TCC have decided to go "transparent" this time?

TTP1- Where are the one or two dozen phony outraged responses we all expect to see from you people? If tivertontaxpayer1's response is the best the lefties in town can do, this must be a sensitive issue they want to die a quiet death: can't have people knowing too much, your postition won't stand the scrutiny. You predictable insult is neither witty, topical or even interesting; "tis (sic) town is in deep trouble." Recommend something more topical/typical of your ilk: "so and so (pick your favorite) is a doo doo head" or something like that. I'd say you need to engage another lefy/union hack for a more amusing response. If this is the best you can do, your lefty campagn to take the town back is in deep, deep trouble. Let's see, we were talking about Roger Bennis' statements regarding the truth or falsehood of what TCC and the current town council have said/produced: in other words, real issues. And you want to talk about...Fred Floon? First time I did a search for this Floon fellow I could find nothing, his record had been expunged from these pages...another search two days later reveals an individual of rare insight, who has the soul of a poet and is a brilliant writer: I think we can all agrree he's probably a genius of some sort.... I thank you for equating the two of us; if I could write half as well I wouldn't be sitting in my house in the rain, listening to the wind blow, engaging with people whose knowledge is not as vast as mine own (you could say it's "half vast") So, my tribute to this Floon guy aside, I'd advise voters to ignore the usual hatred and vitriol directed at the TCC in general and TC in particular from these....people. Read what Roger Bennis had to write and make up you own mind. I think you're in the lead to win the Meatloaf dinner, by raising the spectre of Fred Floon someone who has not posted in ....12 months? I wish Roger would repost his editorial about the evil 22 percent tax increase we read so much about: maybe we can debate that (again) if you like, and see who's lying about what... Are you another believer in "TCC transparency", meaning for everybody but yourself? Tell us how much you and the council really spent on legal fees last year?

Both "Billy" and Justin Katz resort to hurling insults and innuendo in their posts and letter to the editor. in "Billy's" case he can't defend his record on the Budget Committee or as a member of the Town Council. Mr. Katz's latest diatribe called members of the School Committee and the superintendent of school "teachers" implying that teachers are evil. This tactic goes back to the 1950's and Senator Joe McCarthy who claimed that everyone in the state department were Communists. Eventually, he broadened the scope of accusations to include anyone who disagreed with him. Does this sound familiar to "Billy" and Mr. Katz's most recent and baseless assertions?

Let me say this about that: Not a current of former member of the Town Council, least not anywhere in Rhode Island. Your attack on Justin Katz is just silly: again, is this the best you lefties can do? Engage him on facts and specifics...you won't/can't 'cause he'll eat you alive with facts and the truth. Bottom line, vote for the TCC ticket in a week. On second thought, maybe you could make a deal with Justin: If you quit telling lies about him, maybe he'll quit telling the truth about the local democrat party, teacher's union, T1 and CURB. Billy, you and your TCC cronies would not know the truth if you tripped over it. However, you want facts here you go: 1. The TCC led Town Council tried to steal over $$600,000 from the School Department. Said funds were returned to the School Department only after the RI State Supreme Court refused to hear the Town's case. Let's not forget the TC would have had to appear before a superior court and explain why they were not following the rulings of the Commissioner of Education and RI Board of Regents to return the funds. 2. The TC has incurred hundreds of thousands of dollars in unnecessary legal fees. 3. The TC approved $58,000 for a sewer study and another $18,000 for a pump out boat both of which were rejected by voters at the FTR Hearing and by the Budget Committee. 4. The TC never met with the Budget Committtee to develop the 2012-13 municipal budget. 5. The leader of the TCC and member of the TC, David Nelson proposed an alternative budget at the FTR which would have cut the School Department's budget proposal by $600,000 but would have increased municipal spending by 4.5%.

WHY? the TdTc now ignores it's endorsement of the man who robbed providence broke? WHY?These folks wish to FIX the FTR so it goes back to Budget control ONLY, and raise your taxes for teachers, NOT SCHOOLS, NOT KIDS, TEACHERS and that is the truth
