Site-Ready Investigation Heats Up

About a dozen residents left the Town Council meeting on Monday night after council President Jay J. Lambert lost his temper during a discussion about Site-Ready Materials.

 

Conversation about an Eagleville Road business under investigation by the town for possible zoning violations quickly turned into a shouting match at Monday night's Town Council meeting, illustrating the frustration of residents and officials alike.

All the council would tell a group of outspoken neighbors about Site-Ready Materials, the waste management facility on Eagleville Road, was that it was seeking a warrant to gain access to the property.

The town's code enforcer, Gareth Eames, was denied access to the property on several instances this ySite-Ready Materials is also seeking to significantly expand its operations and is engaged in hearings before the Planning Board. 

"We have not gained access to [the property] as of yet," reported Town Administrator James Goncalo. " We are attempting to and we are looking at how we can accomplish this and be sure the permits in place are being followed."

Residents are frustrated that the town will not take a stronger stance against the business owners who they say are demeaning their neighborhood's quality of life.

"Neighbors have witnessed noise at all hours, there are foul odors coming from the property, and dust emitting from the property," said Patricia Pelletier, Eagleville Road resident. "You are telling us that a strong legal stance has not been taken because the business is not responsive. This is not acceptable. These are our most common and basic rights as residents and taxpayers and since it is in the interest of those listed, I ask when you are going to seek a warrant and order a cease and desist."

Pelletier said she and other neighbors were worried about ongoing quarrying - a charge previously investigated by Eames. In 2010, Eames violated he business for on-site blasting, but rescinded the violation after Site-Ready stated the blasting was to level land. According to residents, it continues today. 

The business, according to Pelletier is advertising the sale of gravel - which she said suggests the business is still not in compliance.

The second issue is the on-site composting on leaf and yard waste. Although the business has a valid state Department of Environmental Management permit, the prerequisite town approval does not exist.

"We are very concerned about our drinking water supply," said Pelletier. The entire neighborhood uses private wells for its fresh water. "The Conservation Committee is also concerned and we want the town to contact DEM right away and discuss what is going on."

According to Andy Teitz, town solicitor, the town was limited in what is could do because many of the current concerns deal with proposed uses rather than existing uses on the site. The Town Council does not have authority to approve or deny the business future uses, as it is a matter for the Planning board.

"If they are not legally in compliance now, then they cannot be going for an expansion," said Teitz.  "The Planning Board can in fact choose not to proceed further unless it is provided with a firm explanation of what their current use is."

As council President Jay J. Lambert tried to move the hearing forward, residents, seemingly frustrated with the council's lack of action against Site-Ready began speaking out of turn in the audience and Chief Thomas Blakey had to remind to residents to settle down.

Lambert raised his voice to one resident arguing with council members at the podium.

"Mr. Moran, sit down," said Lambert, raising his voice. When Moran asked why, Lambert replied "Because i told you to and I'm the one who is conducting this meeting. Please try to act like a gentleman."

Resident and local businesswoman Joanne Moniz, a stakeholder in the Tiger Tree lawsuit, called out to remind the council to act quickly or possibly face years more of litigation on the same subject.

"Mrs. Moniz, can I blunt," said Lambert. "Would you shut up."

About a dozen residents got up and left the meeting after Lambert's remarks.

The frustration on both sides of the table at Monday night's meeting stems from a convoluted permitting process  that does not merge state and local goals as well as a drawn-out process to investigate what the business' current activities are.

"i apologize Mrs. Moniz you are entitled to make your comments," said Lambert after several moments pause. "We are trying to be responsive to the extent that we can, but you have to appreciate that there is a process that we have to go through and we truly do not have jurisdiction over the matter that you want to discuss here tonight. It's with the Panning Board."

Council members were scheduled to discuss appropriate actions to take against Site-Ready in executive session on Monday.

"Just ask everybody to please trust us to look into this information that has been brought to out attention because it really doesn't benefit anybody to argue," said Councilman David Nelson.

Let's hope the voters saw what this and the meeting a few weeks ago was, another cheap political stunt by Mr. Nelson and the TCC members of the council to let the angry residents vent that backfired. That reality became apparent at town council meeting Monday evening. Once again, the town council has no authority over this matter.

Yes the council does, people where complaining about current conditions on this property not the future proposal. The town has an obligation to the health and safety of our water supply and the wells. It is clear that that Mr. Lambert, the code enforcer have something to hide here. Mr. Lambert does not care about the residents and does not deserve to be on the council. He did everything in his power to confuse the issue and say that the complaints were about the future and not the present. It everything is legal on this property why will the owners not allow an inspection? I did not see this as a stunt but a issue of major importance that is not getting the attention that it needs.

Some members of the town council, including Mr. Lambert are getting a reputation for loosing their tempers. This isn't personal, it's business. To loose their temper, is to loose control, which is unprofessional. Perhaps, it's time for a house cleaning.

Rug, you are incorrect. If the council wanted to hear complaints about this business they should have properly post such an agenda item and bring the appropriate officials to the meeting. To discuss it under "NEW BUSINESS: Councilor Nelson – Proposal by Site Ready Materials for Eagleville Road" for two meetings in a row is a disservice to the voters of this town and another cheap political ploy by certain members to try and score political points from those that don't know any better.

What you say is to "confuse" the issue is what I say is following the agenda. If you want to criticize Mr. Lambert as a pompous windbag that likes to heat himself speak and yell at others that disagree with him, go right ahead, but you can't criticize him for trying to following the agenda.

The TCC'ers that wanted to grandstand at their meeting should have at least posted the meeting properly. This is another sign to me that they are either incompetent or just don't care to follow the law.

Following the legal process and doing it right will bring the correct results. Jumping off and skirting the law will get the town sued and we will loose. The council is on the right side of this issue. They want to help and will proceed in the right direction.

The Council may be on the right side, but telling members of the public to shut up is not the proper way to conduct a meeting. In my opinion it is an example of the contempt that this Council shows towards the people. Kind of like telling the little people to use the trash bags while others just dump their garbage at work.

I hope that these counsel members are up for re-election. Very unprofessional. How would they feel if this was their neighborhood? Dealing with the noise & smell? Keep Fall River's trash in Fall River! This needs to be investigated. I'm disgusted.

It very clear that Mr. Lambert does not want to hear from residents on this important issue of health and safety. Just what is being dumped on this property in the watershed? What is Mr. Lambert trying to hide? This is the second meeting that Mr. Lambert has tried to misrepresent concerns over current conditions to be concerns over future conditions. The town does not want to inspect this property. Why is this so? The location near private wells and the town water supply should make this of major concern to the town. Why is the heath and safety of residents not important? How could Mr. Eames no nothing about this property that has been operating for years? Why was Mr. Lambert rude and disrepectful to residents who tried to speak about this agenda item? It is very clear that Mr, Lambert is trying to hide something. The town of Tiverton deserves better than Mr. Lambert. It appears that the town is stalling for time in order for Site Ready to clean up the site and get it ready for this inspection. How can anyone trust Mr. Lambert after his display at this meeting? I am happy to say that there is an election in a couple of weeks and Mr. Lambert does not deserve to remain in this office. Where there is smoke there is fire. What kind of town does not want to hear from residents at a public meeting with the item on the agenda? Mr. Lambert feels that he is king and does not have to anwer to residents or voters. Thank god for elections....

Why would the TCC endorse someone who doesn't want people to participate at Town Council meetings? This is intimidation which has not place in a democracy. After all isn't this why we moved to an FTR, so that we could eliminate intimidation?

Actually Rug, yes Nelson and Coulter did behave poorly as did all the rest of the Council who just sat by while Mr. Lambert yelled inappropriately to residents. A council is a democracy with 7 members each having an equal voice and vote. The President is there to facilitate the meeting, he is not King, and the rest of the members bear equal responsibility for not ensuring residents were treated respectfully.

leave us once again discuss the council who submits false budgets to exceed the cap shall we, and The Budget chairman trying to stop the FTR in its tracks, I believe to speak of letters and just leave those 2 out is rather dishonest in it's self, and both were done by elected officals, intended to control the tax rate of this town, and again nn honest name to own what you say? then ignore them

And seriously, the common trait shared by these TCC "leaders" is a lack of character. No one "gave" them power- they took it-and seem to think they are entitled to it. From Dave Nelson's ghost letters and his attempt at intimidating women( and now Jay Lambert too) to Justin Katz tweeting about "the right kind of poor", and numerous blatant lies that speak to character-or rather in the case of the TCC- lack of. The TCC ticket across the board-lacks integrity and character-traits that can not be bought-rather are earned. Tiverton, we have the power to change the TCC "leadership". TCC has got to go.I encourage Tiverton to check out those candidates running on the Tiverton First ticket. Collectively,their reputation, knowledge and skill set speaks directly to character and the ability to move Tiverton-without screaming, sneaky letters, voter intimidation and flat out lying. These are the people to move Tiverton forward. Tiverton First-Tiverton Proud!

Gloria it is easy to paint everyone with the same brush. I did not see Mr. Roderick or Little Brett come to the defense of the people trying to speak. You are taking one thing and making it bigger than it is. Mr. Lambert should not even be on a board or a commission never mind the council. Mr. Lambert acts like a tyrant that has no use for public comment at a public meeting.

Curb/T1 Protct teachers and fix the FTR, again start crying about lowest pay, The school super just said that the number of children needing breakfast is on the raise and Tiverton Proud ignores that because the way to make Tiverton Pround is pay teachers more which can only be done by raising taxes and taking nore money from folks who make less than teachers, and you say you speak for all of Tiverton?. I really , really don't think so, and I hope others agree

I was unable to attend the meeting but saw the video but did anyone speak up to help these people?
I'm not saying that those running on the first ticket, are opposed to helping, but where are they? This place needs a notice of violation and a Cease operation according to the law. Mr. Eames has stated that they are operating a compost facility without the proper permits and other things too,

If there is an oil spill, do we scramble around trying to find out how it happened, or do we stop the oil spill and find out later.

All this takes is someone to step up and tell Mr. Eames to do his job, regardless of the fact that he has not done it all along.

Is that so hard?

It seems the Town Council allows some residents to speak, but that's all that happens. I haven't seen anything be done. -Tiger Landscaping, Garage on Fish Road, Eagleville Rd Garage and now Site Ready. Everything is still as it was before the complaints. Everything gets swept under the rug someone will trip over the lumps. The problems are growing because violators KNOW nothing will be done. Eames needs to go and so do some town council members. All talk NO action, but our votes will speak for us.

Never mind candidates running for Town Council what have the current members of the TC done to address the problem? RD, I notice you never state when this illegal dumping began. Why is this the case? You make a serious claim that illegal dumping is taking place on the site. What evidence have you submitted for public review? If you are unhappy with the TC's response, why aren't you contacting the electronic media regarding your concerns?
